grABloop terms of use#
Version 1 · in force from ⟨date of the first release⟩
These terms are an agreement between you and CODEBORN, the maker of grABloop. Please read them; the parts in bold matter most.
1. Who we are#
grABloop is made by CODEBORN EOOD ("CODEBORN"), a single-member limited liability company registered in Bulgaria, 145 G. S. Rakovski St., apt. 6, Sredets district, 1000 Sofia, Bulgaria, VAT number BG204340963. Email: info@grabloop.change · Telephone: +359 2 950 6127.
2. Agreeing to these terms#
You accept these terms when you choose Accept in grABloop. If you do not agree, do not use grABloop. You can read these terms at any time in Settings ▸ About grABloop ▸ Terms of use, and at grabloop.change/terms. How grABloop handles your information is in a separate text, the privacy notice (Settings ▸ About grABloop ▸ Privacy notice, grabloop.change/privacy).
If you got grABloop from an app store, that store's own terms also apply to getting it and paying for it. Section 15 holds the extra terms for Apple's App Store.
3. Your licence#
CODEBORN gives you a personal, non-exclusive, non-transferable licence to install and use grABloop on devices you own or control, for your own practice, teaching and performances, under these terms and the rules of the store you got it from. You may not sell, rent, lend or sublicense grABloop, or remove its notices. You may not decompile or change it, except where the law or the licence of an open-source part allows it (section 4).
grABloop remains the property of CODEBORN and its licensors. You have only the rights these terms give you.
4. Parts made by others#
grABloop contains open-source software and data made by others. Each comes under its own licence, listed in Settings ▸ About grABloop ▸ Third-party licences. Nothing in these terms limits the rights those licences give you.
5. Your recordings and your rights to them#
- Import only recordings, videos, lyrics and other material you have the right to use. You are responsible for what you import, copy, export, share in a bundle or put in a sync storage, and for respecting the rights of their owners.
- grABloop does not download from streaming services and is not meant for copying music you have no right to.
- What you put in grABloop stays yours. CODEBORN receives none of it and gets no rights to it.
6. Keep your own copies: loss of data#
grABloop never changes the original files you import: it works on copies in its library. Even so, software and devices fail. Your library, with its recordings, loops, bookmarks, notes, lyrics and settings, your backups and your sync storage can be lost, damaged or overwritten, for example by an error in grABloop, an update, a device failure, a restore from a backup, a sync, a trim or a delete. This can happen even when you made backups.
Keep your original files and your backups in more than one place, and check now and then that a backup opens. As far as the law allows, CODEBORN is not liable for any loss of data or for the cost of recovering it (section 10).
7. Sync#
Sync works through a storage you choose and control: your own server (SFTP or WebDAV) or a folder. CODEBORN does not run it, cannot see it and has no access to it.
- You are responsible for that storage: its availability, its security, its cost and the terms of whoever provides it.
- If you encrypt the storage, only your passphrase opens it. If you forget the passphrase, nobody can open what is in the storage, CODEBORN included.
- Sync is for moving between your own devices, not for working on two at once. When the same loop, bookmark or preset, or a song's speed or another setting, is changed on two devices before they sync, the later change is kept and the other is lost. Let one device finish syncing before you go on with another. Typed notes and lyrics are the exception: both versions are kept.
8. Use with care#
- Protect your hearing. grABloop can play loud, and a loop repeats the same passage many times. Start at a low volume, above all with headphones.
- On stage, do not rely on grABloop or on any one device alone. Keep a second copy of what you need (a printout, another device) and check your setlist before you perform.
- grABloop is a practice tool. Its speed, pitch and loop timing are made to sound right; they are not exact measurements.
9. No warranty#
As far as the law allows, grABloop is given as is and as available, with its faults. CODEBORN does not promise that it will work without errors or interruptions, that it will work with every file, device or storage, that it will keep your data safe, or that it suits a particular purpose.
If you are a consumer, you keep the rights the law of your country gives you, among them, where the law gives it, the right to digital content that conforms to the contract. These terms do not take those rights away.
10. Limits of liability#
As far as the law allows:
- CODEBORN is not liable for loss of data, recordings, work, income or profit, for a lesson or a performance that went wrong, or for any indirect or consequential damage, whatever its cause.
- CODEBORN's total liability to you for everything related to grABloop is limited to the greater of what you paid for grABloop in the twelve months before the claim and fifty euros (€50).
Nothing in these terms excludes or limits liability for intent or gross negligence, for death or personal injury caused by negligence, or any other liability the law does not allow to be excluded or limited. If a part of these terms is not valid, the rest still applies.
11. Updates and changes to these terms#
Updates can add, change or remove features. CODEBORN may change these terms; every version has a number and a date. When a change matters to you, grABloop shows the new terms when it starts and asks you to accept them before you go on. If you do not accept them, stop using grABloop.
12. Ending#
You may stop using grABloop at any time by deleting it. On phones and tablets, deleting grABloop also deletes its library: make a backup first.
CODEBORN may end your licence if you break these terms. Sections 5, 6, 9, 10, 13 and 14 still apply after it ends.
13. Law and courts#
These terms are governed by the law of Bulgaria, and disputes go to the competent courts in Sofia, Bulgaria. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you may also bring a claim before its courts.
14. Languages#
These terms are written in English and in Greek. If the two differ, the English text prevails, unless the law of your country requires otherwise.
15. If you got grABloop from Apple's App Store#
These terms are grABloop's licence agreement in the App Store, in place of Apple's standard one, and include the following terms Apple requires.
a. These terms are concluded between you and CODEBORN only, and not with Apple. CODEBORN, not Apple, is solely responsible for grABloop and its content. b. Your licence is limited to using grABloop on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that other accounts associated with you through Family Sharing or volume purchasing may use it too. c. CODEBORN alone is responsible for any maintenance and support of grABloop. Apple has no obligation whatsoever to furnish any maintenance and support services for it. d. CODEBORN alone is responsible for any product warranty, whether express or implied by law, to the extent it is not effectively disclaimed. If grABloop fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to grABloop, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to a warranty are CODEBORN's responsibility, as these terms provide. e. CODEBORN, not Apple, is responsible for addressing any claims by you or any third party relating to grABloop or your possession and use of it, including (i) product liability claims; (ii) any claim that grABloop fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation. f. If a third party claims that grABloop or your possession and use of it infringes that third party's intellectual property rights, CODEBORN, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim. g. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. h. Questions, complaints or claims about grABloop go to CODEBORN at the address in section 1. i. You must comply with the terms of any third party that apply when you use grABloop, for example those of whoever provides your sync storage. j. Apple and Apple's subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
